Discrimination under this Policy is an unequal treatment of a student based on the student’s actual or perceived gender, 性取向, 或妊娠. The 2020 Title IX Regulations define sexual 骚扰 broadly to include any of three types of misconduct that—以性别为基础—jeopardize the equal access to education and the 教育 programs/activities that Title IX is designed to protect. 这三种不当行为是:

Reporting

歧视通知或投诉, 骚扰, and/or retaliation in violation of this Policy may be made using any of the following options:

  1. 向, or give verbal notice to the 第九条协调员 or an Official with Authority or Mandatory Reporter. Such a report may be made at any time (including during non-business hours) through various methods, 包括电话713.313.7037),电邮( TitleIX@TSU.edu), or by discussing your concerns with any Official with Authority or Mandatory Reporter.

A formal complaint is a document filed and signed by the Complainant or signed by the 第九条协调员 alleging a policy violation by a Respondent and requesting that TSU investigate the allegation(s). 投诉可以亲自向第九条协调员提出, by mail, 或通过电子邮件, 通过使用上面部分的联系信息, 或者如本节所述. 如本段所用, the phrase “document filed by a Complainant” means a document or electronic submission (such as by electronic mail or through an online portal provided for this purpose) that contains the Complainant’s physical or digital signature, 可以在电子邮件中包括投诉人的姓名, or otherwise indicates that the Complainant is the person filing the complaint.

刑事调查还为受害者提供了额外的权利 (插入校园保存通知链接). Working with local law enforcement complements an administrative investigation. TSU can only influence the 就业 and enrollment status of an individual. 当地执法部门可以确保社区成员, vendors, students, 或者员工不再在社区环境中继续做出有害的行为. TSU will enforce any court orders and collaborate with local law enforcement during investigations. In most cases, an administrative investigation will be completed prior to a criminal investigation.

报复

TSU’s Title IX 性骚扰 policy strictly prohibits retaliation for engaging in protected activities.

Protected activity under this policy includes reporting an incident that may violate policy, 参与申诉过程, 支持投诉人或被投诉人, 协助提供与调查有关的信息, and/or acting in good faith to oppose conduct that constitutes a violation of this policy. 

It is prohibited for TSU or any member of TSU’s community to take materially adverse action by intimidating, 威胁, coercing, harassing, or discriminating against any individual for the purpose of interfering with any right or privilege secured by law or policy, 或者因为个人提出了报告或投诉, testified, assisted, or participated or refused to participate in any manner in an investigation, 进行, 或根据本政策和程序进行听证. 

  1. The exercise of rights protected under the First Amendment do not constitute retaliation.
  2. Charging an individual with a code of conduct violation for making a materially false statement in bad faith in the course of a grievance 进行 under this policy and procedure does not constitute retaliation. 关于责任的未经证实的决定, alone, is not sufficient to conclude that any party has made a materially false statement in bad faith.

Acts of alleged retaliation should be reported immediately to the 第九条协调员. TSU is prepared to take appropriate steps to protect individuals who fear that they may be subjected to retaliation for engaging in a protected activity.
